The suspended Head of Department (HOD) of Police, Roads and Transport, Sipho Mtakati has, via his legal representatives Matlho Attorneys, requested the Free State Premier Sisi Ntombela to withdraw her decision of suspending him for allegedly failing to ensure that road infrastructure projects were properly managed.
“Allow our client to resume with his duties with immediate effect, failing which we hold instructions to do the necessary to bring your patently unlawful instruction and decision to a halt,” said Attorney Daniel Matlho.
Matlho has indicated that they will be approaching the Labour Court on an urgent basis for appropriate relief to have the suspension uplifted.
According to Matlho, the Free State Premier Ntombela failed to mentioned the five major road infrastructure projects, which she alleges that Mtakati failed to manage properly in the letter.
“Regrettably, it is our view that your recent decision to suspend our client is impugned and riddled with mala fides,” said Attorney Matlho.
In the letter by Ntombela to Mtakati, Free State Premier Sisi Ntombela has suspended Mtakati for allegedly failing to ensure that road infrastructure projects are properly managed.
“I have recently received reports on the dire impact which the collapsing of the major 5 road infrastructure projects is causing,” said Ntombela.
According to Ntombela, Mtakati as the HOD is ultimately responsible to ensure that, once Contractors have been appointed to repair an identified road, which poses a danger to the public traveling on it, that the project is properly managed to its logical conclusion.
Mtakati is also expected to ensure that government funds are appropriately spent.
