QWAQWA – Executive mayor Masetjhaba Lakaje-Mosia on Tuesday told the ordinary council meeting that Maluti-A-Phofung (MAP) has won a case against the Sheriff and a service provider, Kill Crime Security Services.

According to an order by Judge Corne van Zyl of the High Court of South Africa Free State division in Bloemfontein, the second respondent which in this case is First Rand Merchant Bank is ordered to release the funds available in the applicant’s bank account, number. 62026153221, immediately, to allow the applicant to transact on its bank account with immediate effect.

The third respondent which in this case is PK FOKA: Witsieshoek Sheriff is ordered to return the moveable assets, goods and equipment removed from the first respondent which in this case is Kill Crime Security Services possession on Wednesday, 24 April 2024, to the applicant (MAP) immediately.

“The High Court ruled in favour of the municipality, granting a stay of execution order to prevent the attachment of municipal properties, and freezing of municipal bank accounts. However, another case is pending, with the municipality seeking a review and setting aside of a previous order.

In response, the council has authorized Troika and management team to engage in negotiations out of court with the applicant, Kill Crime, to resolve the matter amicably and reach a favourable agreement for all parties involved,” Council whip Moeketsi Lebesa said to this publication.

During the tabling of the budget, some councillors expressed concerns that the budget of 2024/25 does not entirely speak to the needs of the community. EPWP workers are not included in the budget and this raised some eyebrows with councillors because when the municipality’s bank account was frozen they had to be the ones to allay the fears of the workers that they may not be paid on time.
