QWAQWA—Bloemfontein High court has ruled in favour of DS Consortium when it overturns the decision by department of Sprots, Art, Culture and Recreation of awarding a tender to C squared to run Mangaung African Cultural Festival as unlawful and set aside on Monday.
The judgement was granted in favour of the applicant, the director of DS Consortium Mosa Likobo against the department and C-squared who are addressed as first and second respondents respectively.
According to OFM news during the hearing the attorney representing DS Consortium, Joubert Zietman, argued that the specifications of the tender that were changed, were put in the spotlight.
Zietman submitted to court that despite no contract been signed between department and service provider millions have already been spent.
The court also heard that DS Consortium one of the bidders for MacAfee tender knew commencement of Macufe on October 2, with a Gospel event while Soccer match was held on September 25, 2022 instead of October 9,2022 according to the specifications on the tender invitation, thus believed they still have time to appeal.
Commenting on the judgement, department of Sports ,Arts ,Culture and Recreation’s spokesperson Tankiso Zola said the department took note of the Judge’s remarks that Macufe 2022 must go ahead as the judgement is not stopping it.
